After working for over 31 years in Baltimore County Public Schools, Susan embarked on a real estate career with Long and Foster. She has spent the past decade as a member of the Connelly Group and has lived in the Towson and Lutherville area since 1962. Smoke Alarms
Single-family properties can have 1 or 2 dwelling units. Multi-family properties have at least 2 units.
For single-family properties built before July 1, 1975, there must be 1 alarm in every sleeping area and 1 alarm on every floor of the home (except for attics and garages). All alarms need to be sealed, long-life battery alarms with a silence button.
For single-family properties built between July 1, 1975 and January 1, 1989, there must be at least 1 AC smoke alarm in every sleeping area and 1 alarm on each floor of the home (except for attics and garages). If the AC alarms are battery powered, they should be sealed, long-life alarms with a silence button. The alarms must be under 10 years old.
For single-family properties built between January 1, 1989 and July 1, 1990, there must be at least 1 hard-wired and connected smoke alarm in every sleeping area and 1 alarm on each level of the home including the basement but excluding attics and garages. The alarms must be under 10 years old.
For single-family properties built between July 1, 1990 and July 1, 2013, there must be at least 1 alarm in every sleeping area and 1 alarm on each floor of the home, including the basement but excluding attics and garages. All alarms must be hard-wired and have a battery back-up. The alarms must be under 10 years old.
For single-family properties built after July 1, 2013, there must be at least 1 smoke alarm in every sleeping area and at least 1 in every hallway or common area. Additionally, there must be at least 1 smoke alarm on every floor including the basement but excluding attics and garages. If a new residence needs at least 2 alarms, the alarms need to be connected to go off at the same time. All alarms should be hardwired with a battery back-up.
Any properties receiving renovations are treated like properties built after July 1, 2013.
For multi-family units built after July 1, 1990, smoke alarms must be hard-wired with battery back-ups. All landlords must provide special smoke alarms for the deaf and hard of hearing. Landlords have sole responsibility for installing, repairing and replacing smoke alarms. Tenants are responsible for testing smoke alarms and keeping landlords abreast of any failures or malfunctions. All alarms should be under 10 years unless they are tested and calibrated annually.
Sellers should inform homebuyers about the age of smoke alarms and whether or not the batteries are tamper-resistant. Sellers should answer any questions completely and honestly. If a seller is placing the home on the market as is, they are still required to disclose any defects.
If you are a listing agent, you do not need to ask sellers if a property is compliant. If you do observe something that makes you think something is wrong with a smoke alarm, you should inform the seller that there are updated requirements as of January 1, 2018.
If you are a buyer agent, the buyer should ask about smoke alarm compliance. If you know that a property is not compliant, you need to disclose this information and your source to the buyer. As with any other material fact disclosures, you need to attach the disclosure to the Maryland Real Property Disclosure or written on branded letterhead.

Tell the seller that local fire marshals are willing to assist in evaluating whether or not smoke alarms are compliant.
Home inspectors are not required to inspect smoke alarms and determine compliance with updated laws. The Code of Maryland Regulations (COMAR) governing what home inspection reports must include states that home inspectors should include only the absence of smoke detectors.
